TERMS AND CONDITIONS OF USE
This Agreement governs the terms under which you ("the Client") access and participate in the immersive theatre experience ("the Experience") offered by Wonder Adventure Company Limited ("the Company"), a business registered in Thailand. By checking the "I Agree" box and proceeding with the purchase, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. The Company operates via its Internet website
www.wonderadventure.co through the Telegram application, collectively referred to as the "Platform."

2. Scope of Application of These Terms and Conditions
2.1 The Company reserves the right to modify these Terms and Conditions at any time. The applicable version will be the one agreed upon by the Client at the time of purchase. The Client is responsible for ensuring they have read and understood the latest version available on the Website before making a purchase.
2.2 Should any portion of these Terms and Conditions be deemed invalid under applicable Thai laws, the remaining terms shall remain in effect.
3. Product Description
The Company provides an immersive theater experience consisting of audio content and a series of stops at designated locations in Thailand. The Client is responsible for arranging transportation between the locations using their own personal vehicle or another suitable means of transport.
Participants must be at least 18 years old to engage in the Experience.
4. Personal Data
4.1 The Client acknowledges and agrees that the Company may collect, store, and process personal data provided during the purchase and participation in the Experience, in compliance with Thai data protection laws.
4.2 The Company collects personal data such as name, email address and payment information for the following purposes:
- Processing the purchase of the Experience.
- Communicating with the Client regarding the Experience.
- Providing support and updates related to the Experience.
- Complying with legal and regulatory obligations.
4.3 The Company will take reasonable precautions to secure Client data but acknowledges that no method of transmission over the internet or electronic storage is completely secure.
4.4 The Company may share personal data with third-party service providers involved in processing transactions or providing services related to the Experience. These third parties are required to comply with applicable data protection laws.
4.5 The Client acknowledges that while the Experience is conducted via Telegram, personal data may also be processed by Telegram as per its Privacy Policy. The Company does not have control over data processing conducted by Telegram. Clients should review Telegram's privacy policies independently.
4.6 By submitting a review in Telegram after the performance, users grant permission for their feedback to be published on our website and social media platforms for promotional purposes.
4.7 The Client agrees that their email address may be used not only to send necessary instructions before the Experience but also to provide updates on future performances. Clients can unsubscribe at any time.
5. Client Responsibilities
The Client is solely responsible for their own actions, including but not limited to:
- Ensuring they meet the minimum age requirement of 18 years.
- Compliance with all local laws and regulations, including traffic laws.
- Ensuring their personal safety and the safety of others while participating.
- Maintaining the functionality of necessary equipment (smartphone, headphones, power bank, and transportation).
- Ensuring they have access to a stable internet connection to interact with the Telegram bot.
- Following all provided instructions to optimize safety and engagement in the Experience.
6. Assumption of Risk
By participating in the Experience, the Client acknowledges and assumes any risks involved, including but not limited to:
- Vehicular accidents.
- Personal injury.
- Property damage.
The Company is not liable for any incidents occurring during the Client’s participation in the Experience.
7. Limitation of Liability
The Company provides the Experience "as-is" and makes no warranties regarding safety, suitability, or outcomes. The Company is not responsible for:
- Any accidents, injuries, or damages occurring during travel between locations.
- Any loss or damages resulting from participation in the Experience.
- Any unforeseen events, including personal accidents, vehicle breakdowns, or other incidents.
8. Waiver of Liability
By participating, the Client releases the Company and its employees, agents, and partners from any claims related to injuries, damages, or accidents arising during the Experience.
9. Indemnification
The Client agrees to indemnify and hold the Company harmless from any claims, damages, losses, or legal fees arising from their participation.
10. Use of Telegram Bot
10.1 The Experience is conducted via a chatbot in the Telegram application. Participants must have an active Telegram account and ensure they have access to the platform for the duration of the Experience.
10.2 The Company is not responsible for any interruptions, malfunctions, or restrictions imposed by Telegram that may affect participation.
10.3 Participants acknowledge that interactions with the Telegram bot may involve data processing by Telegram, which is outside the Company's control. Clients should review Telegram’s privacy policies independently.
10.4 The Company is not liable for any disruptions caused by poor internet connection, device malfunctions, or failure to follow setup instructions for Telegram.
11. Use of Payment System
11.1 The Company uses third-party payment providers to process transactions. By completing a purchase, the Client agrees to the terms of the payment provider. The Company is not responsible for any transaction errors or disputes.
11.2 Transactions are secured via STRIPE, with SSL encryption ensuring protection of payment details. The Client must follow the payment provider’s security protocols, including 3D Secure authentication.
11.3 The Company reserves the right to modify the pricing of its services or products at any time without prior notice. Payment is processed at the current price at the time of purchase. Previously made payments are non-refundable and will not be adjusted in case of price changes.
12. No Refunds
Once purchased, the Experience is non-refundable unless otherwise required by Thai law.
13. Service Availability
13.1 Access to the Experience through the Telegram bot is subject to the availability and proper functioning of the Telegram platform. The Company is not responsible for any service outages, suspensions, or technical failures affecting Telegram that may impact participation. 14. Governing Law and Dispute Resolution
14.1 This Agreement is governed by and construed in accordance with the laws of Thailand.
14.2 The Parties agree to make every reasonable effort to resolve any dispute, controversy, or claim arising from or related to this Agreement through amicable negotiations.
14.3 If a resolution cannot be reached, the dispute shall be referred to mediation before resorting to arbitration or litigation.
14.4 If mediation does not lead to a resolution, disputes shall be resolved through arbitration under the Thai Arbitration Institute, with proceedings conducted in English. Litigation in Thai courts shall be considered only as a last resort if arbitration fails to resolve the matter.
15. Intellectual Property
15.1 All elements of the Experience, including but not limited to audio content, texts, scripts, visual materials, music, branding, and the overall concept, are the exclusive intellectual property of Wonder Adventure Company Limited. Any unauthorized use, reproduction, distribution, modification, or adaptation of any part of the Experience is strictly prohibited.
15.2 Participants are welcome to share information about the Experience and its official website via social media, personal blogs, or word-of-mouth, provided they do not misrepresent the Experience, alter its branding, or claim any form of ownership.
15.3 Any use of the Experience’s content, including commercial use, resale, translation, or replication of its core concept, must receive explicit written permission from Wonder Adventure Company Limited. Unauthorized use will result in legal action.
15.4 The Experience is a unique and original creative work. Any attempt to copy, imitate, or reproduce its structure, narrative, mechanics, or artistic elements will be considered intellectual property infringement and prosecuted under applicable Thai and international copyright laws.
16. Rule of Evidence
The Client acknowledges that electronic communications, log files, and statistical data generated by the Company shall have the same evidential value as written documents.
17. Entire Agreement
This Agreement constitutes the full understanding between the Client and the Company, superseding all prior agreements. By completing the purchase, the Client agrees to these terms.
